Memo on state legislation restricting meetings of 'state bodies,' including the CalPac Certification Panel

The Brown Act was enacted in 1953 to guarantee the public’s right to attend and participate in meetings of local legislative bodies, and has been modified several times since then. The Bagley-Keene Act of 2004 expands on the Brown Act regarding meetings of “state bodies,” which includes the CalPac SRM Certification Panel.

The Certification Panel is required to distinguish “open” sessions, to which the public is invited, from “closed” sessions, which are not open to the public. The closed sessions cover material that is confidential, such as applications, exam details, complaints, legal issues, and other topics not ready for public announcement. The Panel must give at least 10 days notice to the Foresters Licensing Office of the Board of Forestry and Fire Protection that an open session meeting will be held, providing the attendance details and an agenda. The Foresters Licensing Office will then prepare a condensation of that information for posting on their website. Members of the public may call the Foresters Licensing Office to be given the details to call-in for teleconferences, or to attend in-person meetings, and then participate in the open session of the meeting only. Members of the public will be asked to identify themselves at the start of open sessions, and to excuse themselves during closed sessions of the meeting.
